25/11/2009 - HMV in the dock over live music
High street chain HMV is being prosecuted for allowing Britain's Got Talent finalist Faryl Smith to sing in one of its stores.
The 14-year-old mezzo-soprano burst into song while signing copies of her debut album at the Newlands shopping centre, in Kettering.
But the council says the store had not applied for the appropriate licence for the event, and is now suing the chain over the incident.
"It's a routine prosecution. It doesn't matter who the artist is. We offered HMV the opportunity to apply for a retrospective licence but they refused," a council spokesman said.
No action will be taken against Ms Smith, the representative added.
A spokesman for HMV spokesman denied the company had been offered any deal.
