22/12/2010 - Fencing firm ignores HSE orders

A Gloucester fencing firm has been fined after ignoring orders to improve its facilities.

The Health and Safety Executive (HSE) had presented Andy Sutton Fencing Ltd with formal Improvement and Prohibition Notices to provide hot water for workers and ensure its local exhaust ventilation system was working.

HSE inspectors also ordered the company to protect staff from wood dust and dangerous machinery at its base on Great Western Road.

Business owners might be spurred on to make sure they take every possible precaution in future such as carefully monitoring safety at their bases while ensuring the best possible liability insurance.

These offences were brought to the HSE's attention following a complaint, which led to a visit by inspectors in March 2010.

A month after the compliance date, a follow-up inspection uncovered that the company had failed to comply with two of the improvement notices.

Andy Sutton Fencing Ltd, of Great Western Road, Gloucester was fined £3,000 and handed £2,369 in legal costs after admitting to two breaches of Section 33 (1) (g) of the Health and Safety at Work Act 1974 at Gloucester Magistrates' Court.
