10/02/2010 - Director fined over legionella risk
A managing director has been ordered to pay out £3,000 for failing to control legionella at his firm's site.
Ernest Jones, of Coseley-based First Metal Finishers Ltd, admitted breaching health and safety laws at Dudley Magistrates' Court.
Jones, of Rugeley, Staffordshire, was fined £2,000 and ordered to pay £1,000 costs for neglecting to put a management system in place for the control of legionella, despite previous warning notices from water treatment contractors.
The court heard how inspectors visiting the site in Cannon Business Park found there had not been a management system in place for eight months and that other required checks had not been undertaken.
The Health and Safety Executive stressed that managing directors had a duty to act upon cases like this as soon as possible.
Legionella can make people seriously ill and in severe cases can kill.
