20/01/2010 - Caterer must pay damages to widow
Appeal judges have upheld a ruling that a caterer who served up an egg-containing dish at a Sikh wedding must pay damages after a man died from an allergic reaction.
The Court of Appeal ordered Prem Dubb to pay Kuldip Singh Bhamra's widow, Amarjit, £415,000 in compensation, plus £36,000 interest.
The court heard Mr Bhamra was aware of his allergy but thought the wedding banquet, at a London Sikh temple, would be safe because observers of the religion do not eat eggs.
Three appeal judges upheld an earlier ruling at Oxford County Court in November 2008 that Lucky Caterers was negligent for serving the ras malai dessert ,which allegedly contained the egg, at the ceremony in August 2003.
Ruling judge, Lord Justice Moore-Bick, said there was evidence that more guests had attended the wedding than anticipated and Mr Dubb had sent out for more supplies.
He had denied this but the county court judge had rejected that part of his evidence and found that he had bought in ras malai from an outside source and it contained egg.
