07/06/2010 - Boss fined over lack of insurance

Bosses are being warned about the importance of employers' liability insurance after an uninsured car wash owner in Essex was fined £2,500.

Bledar Shtylaa, the owner of Blue Flag Hand Car Wash in Burnham-on-Crouch, admitted breaching the Employers' Liability (Compulsory Insurance) Act at Chelmsford Magistrates' Court, where he was also ordered to pay £1,037 in costs.

The court heard Mr Shtylaa could not produce a current insurance certificate upon inspection by health and safety officers in October last year.

It is compulsory for all employers to purchase a Employers' Liability Compulsory Insurance (ELCI) certificate, which protects members of staff from injury costs.

Mr Shtylaa was handed an ELCI notice to produce, but it came to light that he had not taken out the relevant insurance since November 2006 when he opened the business.

Health and Safety Executive Inspector Kaitav Patel said: "This case should serve as a warning to all employers about how seriously HSE takes this issue. Injuries to employees can potentially stop them working for a period of time or even for life. This type of insurance means that they will not be left to fend for themselves and their families when hurt in an incident."
