29/03/2010 - Firm fined after bricklayer injured

An East Yorkshire building company has been prosecuted after a construction worker was badly hurt when run over by a digger.

Bryan and Michael Kendra, the two brothers who run L & S Kendra & Sons, Meadow Bank, Melbourne, were each fined £9,000 after admitting breaching the Health and Safety at Work etc Act 1974.

Bricklayer Andrew Trezise, 56, was struck by a reversing 360 degree excavator digger driven by Bryan Kendra at a construction site at May Cottage, Mill Lane, Seaton Ross, Beverley Magistrates' Court heard. Mr Trezise suffered a broken pelvis and serious leg injuries in the incident on 29 July 2009.

The brothers were also each ordered to pay £2,500 in costs.

The HSE investigation found that there were no markings to indicate where the digger was working, to ensure that it was separated from pedestrian movements on site. A reversing assistant had not been deployed to oversee reversing manoeuvres for the digger prior to the incident.

After the hearing HSE Inspector Geoff Clark said: "It is essential that steps are taken to segregate moving machinery, such as diggers, from other people on site".
