17/11/2010 - Firms fined £24,000 over injuries

Three firms have been fined £24,500 in total after a man suffered serious leg injuries when he was trapped under a prefabricated wall.

Electrician Martin Cox, from Hayling Island, was trying to lift the wall - which was 10.4m long and 2.8m high - along with six other men when the incident occurred, Portsmouth Crown Court heard.

The 28-year-old was injured on the BAE Systems site in Broad Oak, Portsmouth, on August 20, 2008. The three firms have been prosecuted by the Health and Safety Executive and all admitted breaking health and safety legislation.

Principal contractor Emcor Facilities Services and subcontractor, BS Interiors (South), decided to build the wall flat on the floor. BAE Systems had the role of construction design and management co-ordinator and had to ensure the design could be built without risks to health and safety. It failed to carry out those checks.

There were also problems in how the operation was planned and the manual handling of the wall, which were not flagged up by Emcor Facilities Services.

BAE Systems Properties, of Warwick House, Farnborough Aerospace Centre, Farnborough, Hampshire, was fined £8,000 and must pay costs of £6,110

Emcor Facilities Services, of Birdhall Lane, Stockport, Cheshire, was fined £15,000 and ordered to pay costs of £6,110. BS Interiors (South), of Cardiff Road, Portsmouth, was fined £1,500.
