07/10/2010 - Firm fined over fatal work incident
A construction firm which pleaded guilty to breaching health and safety rules following the death of a man involved in an accident at work has been fined £10,000.
Newcastle Crown Court heard employees of James Swinton Co Ltd were carrying out refurbishment work in Tweedmouth when Charles Wilkinson was struck by a telehandler being reversed the wrong way along a one-way street by a co-worker.
The court heard the Hawick-based company had not asked for a road closure from the local council and there were still cars parked in the residential street.
Mr Wilkinson, 51, from Berwick, was taken to hospital with injuries to his pelvis, spine and ribs, which he suffered when the vehicle mounted the pavement.
He was released from hospital after treatment but died four weeks later as a result of a blood clot, which a pathologist said was caused by the incident at work. The firm was also ordered to pay £4,063 costs.
